Terms of Use / Conditions of Use

AutoViffy means Autoviffy, together with its affiliates, successors, and assigns. In these Terms, “AutoViffy,” “we,” “us,” and “our” refer to that entity.

You may use the Services only if you:

• are the age of majority in your jurisdiction;
• have legal capacity to enter into a binding agreement;
• provide accurate information when creating an account or using the Services; and
• if acting for a business, have authority to bind that business.

You may need an account to access certain Services. You agree to:

• provide accurate, current, and complete information;
• keep your login credentials confidential;
• promptly update account and business information;
• accept responsibility for activity under your account; and
• notify AutoViffy immediately of unauthorized access or suspected misuse.

AutoViffy may refuse, suspend, restrict, or terminate accounts where we reasonably believe there has been fraud, misuse, inaccurate information, unauthorized activity, or violation of these Terms.

AutoViffy may offer one or more mechanic or automotive-shop partner programs, including:

Marketing Plan / Market and Get Noticed: verified shops may receive an AutoViffy Verified Mechanic designation, business profile, platform visibility, social promotion, and geofenced advertising opportunities where available.

There is no cost to create an AutoViffy partner account unless AutoViffy separately states otherwise. Program availability, eligibility, benefits, compensation, visibility, and promotional features may vary by location, account status, verification status, and AutoViffy’s then-current program rules.

You may use the Services for lawful personal or business purposes consistent with these Terms. You may not:

• scrape, bulk download, resell, copy, or reverse engineer AutoViffy data, reports, pages, maps, business listings, or software;
• use AutoViffy reports or data to create a competing vehicle-history, valuation, advertising, or lead-generation product without written permission;
• submit false, duplicate, misleading, incomplete, artificially generated, or unauthorized service records;
• interfere with the Services or attempt to bypass security controls;
• upload malware, spam, or unlawful content;
• impersonate another person, business, shop, insurer, lender, owner, or authority;
• use the Services in a way that violates privacy, consumer protection, anti-spam, intellectual property, or other applicable laws; or
• use the Services for automated decision-making where prohibited by law or where human/legal review is required.

AutoViffy may provide vehicle history information based on data submitted by mechanic partners, shops, third-party data providers, public or private sources, user submissions, and other sources available to AutoViffy.

AutoViffy reports are informational tools. They are not a substitute for:

• a professional mechanical inspection;
• ownership, lien, title, insurance, or registration verification;
• legal, financial, insurance, safety, or valuation advice; or
• your own due diligence before buying, selling, financing, insuring, or repairing a vehicle.

Vehicle records may be incomplete, delayed, inaccurate, unavailable, or not reported to AutoViffy. Some repairs, damage, insurance events, odometer readings, title events, service visits, inspections, recalls, or other vehicle events may not appear in an AutoViffy report.

AutoViffy does not guarantee that any report contains every issue, accident, repair, service visit, claim, title event, ownership event, odometer reading, lien, recall, defect, or risk relating to a vehicle.

You may submit information, records, documents, photographs, business profile details, reviews, service descriptions, and other content. You represent and warrant that:

• you have the right to submit the content;
• the content is accurate to the best of your knowledge;
• the content does not infringe third-party rights;
• the content does not contain unlawful personal information or confidential third-party information unless properly authorized; and
• the content complies with these Terms and applicable law.

You grant AutoViffy a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, store, verify, analyze, publish, distribute, display, and commercialize submitted content and data for the purposes of operating, improving, marketing, and providing the Services, including vehicle history reports, mechanic discovery, fraud prevention, analytics, and partner programs.

The Services, AutoViffy name, trademarks, designs, reports, layouts, software, databases, and related content are owned by AutoViffy or its licensors. Except as expressly permitted, you may not copy, modify, reproduce, distribute, sell, license, or create derivative works from AutoViffy materials.

The Services may include third-party links, data, integrations, maps, payment processors, advertising tools, analytics tools, or partner services. AutoViffy is not responsible for third-party websites, content, policies, accuracy, or availability.

Certain Services may require payment. Prices, taxes, billing methods, subscriptions, partner fees, report fees, or promotional offers may change at any time. Unless required by law or expressly stated, fees are non-refundable once a report, subscription, listing, promotion, or digital service has been delivered or made available.

AutoViffy may suspend or terminate access to the Services if you violate these Terms, submit inaccurate or fraudulent information, misuse the Services, create risk for AutoViffy or other users, fail verification, fail payment, or where required by law.

AutoViffy may modify, suspend, or discontinue Services, features, partner programs, eligibility rules, data sources, pricing, or these Terms. Updated Terms become effective when posted or otherwise communicated. Continued use of the Services after changes means you accept the updated Terms.

These Terms are governed by the laws of Ontario, Canada, excluding conflict-of-law rules. Courts located in Toronto, Ontario will have jurisdiction unless applicable consumer protection law requires otherwise.
