Vehicle History Report Disclaimer and Limitation of Liability

AutoViffy attempts to collect, verify, organize, and present vehicle history information from available sources. However:

• not every event is reported to AutoViffy;
• data may be delayed, incomplete, inaccurate, duplicated, or inconsistent;
• some vehicles may have no records or limited records;
• service records may depend on mechanic/shop participation;
• repairs performed by owners, non-participating shops, mobile mechanics, insurers, fleets, dealerships, body shops, or other parties may not be available;
• damage may not have been reported to an insurer or third party;
• records may change after a report is generated;
• a submitted service record confirms only that a record was submitted and accepted into AutoViffy’s system; it does not guarantee repair quality, vehicle safety, future performance, or the absence of other issues; and
• AutoViffy may reject, remove, modify, or update records after review.

To the maximum extent permitted by law, AutoViffy reports and Services are provided “as is” and “as available.” AutoViffy disclaims all warranties, representations, or conditions, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, availability, timeliness, or reliability.

AutoViffy does not provide legal, financial, insurance, appraisal, valuation, safety, repair, or mechanical advice. Users should conduct independent due diligence, obtain professional inspections, confirm ownership/title/lien status, and consult qualified professionals before making vehicle-related decisions.

To the maximum extent permitted by law, AutoViffy and its affiliates, officers, directors, employees, contractors, partners, data providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or economic damages, including lost profits, lost business, loss of data, lost opportunity, loss of goodwill, vehicle purchase losses, repair costs, diminished value, or decisions made in reliance on an AutoViffy report.

Where liability cannot be excluded, AutoViffy’s total aggregate liability will be limited to the greater of:

• the amount paid by you to AutoViffy for the specific report or Service giving rise to the claim; or
• CAD $100.

AutoViffy is not responsible for delay, outage, failure, inaccuracy, or unavailable data caused by events beyond our reasonable control, including third-party data-source issues, shop submission delays, platform outages, cyber incidents, payment processor failures, labour disruptions, utility or internet failures, governmental action, natural disasters, fires, floods, epidemics, or other force majeure events.
